reflash of vehicles with Throttle by wire

Does the reflash of TSX/Accord vehicles include or could possibly include a change in the way the throttle-by-wire works. I have a serious problem with my 2008 accord surging during acceleration and also during shifting it bogs very badly at times. Also during three of the bad shifts the car backfired.

My honda dealer won't/can't do anything about it because there are no CEL's and they are unable to reproduce the problem or are just not feeling it.

None of our reflashes change the drive by wire behavior.

Is it something you dont have access too or you just don't want to mess with it.

Liability reasons. We're concerned that someone who makes a mistake will use lawyers to look for other parties to lay the blame on. Search 'Audi 5000'. Thus is it better not to make any changes in the DBW module.
